Welcome to OHSOFUN. Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using the OHSOFUN website, mobile application, or any other services provided by OHSOFUN (collectively, the "Services"), you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

2. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Services, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of the Services following notification of changes will constitute your acceptance of such changes. If you do not agree with any modifications to these Terms, you must immediately stop using the Services.

3. Account Registration and Security

To use certain features of the Services, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify OHSOFUN immediately of any unauthorized use of your account.

We reserve the right to disable any user account at any time, including if we believe that you have failed to comply with these Terms.

4. User Conduct

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe the rights of any third party, including intellectual property rights, privacy rights, or publicity rights
  • Post or transmit any content that is unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Services or servers or networks connected to the Services
  • Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
  • Use any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Services
  • Collect or harvest any information about other users without their consent
  • Promote or engage in any fraudulent or illegal activities

5. Events and Tickets

OHSOFUN provides a platform for event organizers to list events and for users to discover and purchase tickets to those events. OHSOFUN is not the organizer of the events listed on our platform and is not responsible for the events, their content, or their safety.

When you purchase tickets through our Services, you agree to comply with all terms and conditions set by the event organizer, including any age restrictions or other requirements for attendance. All ticket sales are final and non-refundable unless otherwise specified by the event organizer or required by law.

Event organizers are responsible for setting ticket prices and fees. OHSOFUN may charge service fees for facilitating ticket sales through our platform. These fees will be clearly disclosed before you complete your purchase.

6. User Content

Our Services may allow you to post, upload, publish, submit, or transmit content, including but not limited to text, photographs, videos, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Services.

By posting User Content on or through the Services, you grant OHSOFUN a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license (with the right to sublicense) to use, copy, modify, display, distribute, and otherwise exploit such User Content in connection with the Services and OHSOFUN's business.

You represent and warrant that: (i) you own the User Content or have the right to grant the rights and licenses described in these Terms, and (ii) the User Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person.

7. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by OHSOFUN, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your Web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use and not for further reproduction, publication, or distribution
  • If we provide social media features with certain content, you may take such actions as are enabled by such features

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. OHSOFUN DOES NOT WARRANT THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

OHSOFUN MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICES, INCLUDING BUT NOT LIMITED TO EVENT LISTINGS, DESCRIPTIONS, OR OTHER INFORMATION PROVIDED BY EVENT ORGANIZERS OR USERS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OHSOFUN, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

10. Indemnification

You agree to defend, indemnify, and hold harmless OHSOFUN, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of South Africa, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of South Africa, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

12. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to the interests of another user, a third-party, or us. Upon termination, your right to use the Services will immediately cease.

13. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

14. Entire Agreement

These Terms, our Privacy Policy, and any other agreements expressly incorporated by reference herein, constitute the sole and entire agreement between you and OHSOFUN regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
